When one company owns the marks and the others use them

If your holding company licenses its marks to the companies that run the brands, you have homework the USPTO never reminds you about. Check the quality. Keep the license current. Make sure the name in the website footer matches the owner on the register.

What usually goes wrong

The license nobody checks

A license with no quality control can be treated as giving up the mark. The quarterly reviews were supposed to happen. Nobody wrote down the ones that did.

The wrong name on the record

The operating company on the website, the holding company on TSDR, and a footer that names neither. Anyone can spot that mismatch, including the other side in a dispute.

A dozen renewals on a dozen clocks

§8 in years five and six, renewal in years nine and ten, then every ten years. Each registration runs on its own schedule. Miss one and you lose the registration.

The parts that matter for you

Your structure, on the record
Every mark has an owner and a brand. Every brand has a company that runs it. Archecura shows the chain and flags a brand run by a company that doesn’t own the mark and has no license to use it.
Licenses with a review calendar
Quarterly, twice a year, or yearly. Each period closes when you record a quality check. Miss more than one quarter and the docket calls it out.
Renewals on the docket
§8, §15, and §9 for every registration, with the window, the due date, the grace period, and the fee floor. Reminders at 180, 90, 30, and 7 days, then daily during grace.
A warning before the wrong assignment
Assigning an intent-to-use application before use is alleged can void it. The record tells you before anyone signs.
